Agreeing to these terms
These terms cover your use of the Heritage Appleton Concrete and Masonry website and any estimate or work you get from us. By using the site, asking for an estimate or hiring us, you agree to them.
If you don't agree, please don't use the site. You can still contact us with questions before you decide anything.
What we do and what the website is for
We're a masonry contractor in Appleton, WI, and we do concrete and masonry work for homeowners in Appleton and the cities around it. You can read more about us on our About page and see our services from the home page.
What's on this website is general information about masonry and concrete work. It isn't a quote, a promise of results or advice about your house, because every job depends on what we find once we see it in person.
Estimates and pricing
We give free in-person estimates with no obligation, because we can't price masonry fairly without seeing the wall, chimney, foundation or slab ourselves. An estimate covers the work it describes, based on what we could see that day.
Older brick, block and concrete can hide problems that only show up once the work is open, like soft mortar behind a sound face or poor fill under a slab. If we find something like that, we'll stop and explain it to you, and any change in scope or price goes in writing before we do the extra work.
Material prices can move, so an estimate holds for the time it states. After that, we may need to update it before we schedule the job.
Scheduling, weather and cancellation
We schedule work once you've accepted the estimate or signed the contract. Masonry and concrete depend on weather, so we may move a date when rain, freezing temperatures or heat would hurt the work, and we'll tell you as soon as we know.
If you need to reschedule or cancel, call us at (920) 454-9038 as early as you can. If you cancel after we've ordered materials made or cut for your job, or after work has started, you agree to pay for those materials and the work already done, as your contract sets out.
Payment terms
Your written estimate or contract sets out what you owe, when it's due and how you can pay. If it calls for a deposit, we'll order materials and hold your date once we receive it.
Payment is due on the dates your contract gives. If a balance goes unpaid, we may stop further work and use the collection steps Wisconsin law allows, including lien rights where they apply.
Your part of the job
We need clear access to the work area and accurate information about your property, including where property lines sit and anything you know about buried lines, drainage or past repairs. If something you told us turns out to be wrong, the price or schedule may change.
Some masonry work needs a permit from the city or county. Your contract will say who applies for it, and if you're unsure whether your job needs one, ask us before work starts.
Warranties and what they cover
We're licensed and fully insured. Any warranty on our workmanship is the one written into your contract, and it covers only what the contract says.
Products we install, like pavers, block, stone veneer, fireplace units or sealers, carry their makers' warranties, and we pass those on to you. Beyond what's in writing, we don't make any other warranty, express or implied, to the extent the law allows.
Warranties don't cover damage from settling or frost movement in soil we didn't prepare, poor drainage around the work, de-icing salt, impacts, changes made by others or care that doesn't follow the maker's instructions. Natural materials also vary, so slight differences in color, texture and matching old brick or mortar aren't defects.
Limits on our liability
To the extent the law allows, Heritage Appleton Concrete and Masonry isn't liable for indirect or follow-on losses, such as lost use of your property, lost income or emotional distress, from our work or from using this website.
If we are found responsible for a loss, our total liability is limited to the amount you paid us for the work the claim is about. Nothing here limits any right that Wisconsin law says can't be limited.
If we disagree
If you have a problem with our work or a bill, call us first, because most issues get settled with a conversation and a visit to look at it together. If that doesn't work, we both agree to try mediation in good faith before going to court.
If a dispute still isn't resolved, it will be heard in the Wisconsin state courts for the county where the work was done.
Which law applies
These terms, and any work we do for you, are governed by the laws of the State of Wisconsin.
Changes to these terms
We may update these terms from time to time, and the version on this page is the current one. Changes don't alter a signed contract for work already agreed.
If you have questions about these terms, reach us through our Contact page or call (920) 454-9038, and we'll respond within 1 business day.
